Is there a building code that requires the builder to put a fireplace hood or mantel in a new house? Can a builder be held liable if the heat travels upward and damages the wall above the fireplace?

A fireplace hood or mantel would needed if the manual for the specific model required it for installation. As for the liability, that would be a question for a lawyer or building inspector in your particular area.

Yes, this is a surface-mount hood and it would require anchoring into the surrounding marble since it should not be attached to the fireplace itself. Since it is a surface-mount hood, an Empire-branded fireplace is not required for installation.

This product would need to extend wider than your fireplace by a minimum of 1" on each side of the fireplace. There is no height requirement for a television to be above a fireplace, although the higher above the opening, the better due to the amount of heat that is directed up out of the fireplace.

Yes, this is a surface-mount hood. Please note, however, it is not an outdoor-rated hood and would be subject to eventual rust and corrosion. Unfortunately, we do not sell a stainless steel hood that is universal like this one.

This hood may indeed be mounted on the surface above the fireplace opening and a hood like the product in question should always be used with ventless gas logs. If the television is installed above the mantel and the mantel is installed at the proper height above the fireplace opening per the gas log manufacturer's minimum mantel clearance requirements, this hood should protect the television and mantel.

We have an insert that has started to ruin the mantle above it. The insert already has a hood so this would be in addition to the current hood. Would something like this work? The insert is approximately 4in deep, so this should still stick out 1/2 in. Just not sure if that is enough to protect the mantle above.

We apologize, but there is no way for us to know if an additional 1/2" projection will sufficiently protect your mantel. We recommend verifying your model's specific mantel clearance requirements, which should also indicate if such clearances can be reduced by a hood, and, if so, what the projection of the hood should be.
